Terms of Service

1. Who operates ModScout

ModScout (themodscout.com) is operated by Daniel Colwell, a sole proprietor based in Idaho, United States. These Terms are a contract between you and Daniel Colwell doing business as ModScout. You can reach us at modscout.dev@outlook.com.

2. What ModScout is

ModScout ranks aftermarket automotive brands by community reputation and fitment reliability for a specific vehicle and modification category. The free ranked list is based on accumulated enthusiast forum consensus. The paid report adds live web search on top of that. See our About page for how it works.

3. Not professional or legal advice

ModScout's content reflects community consensus and AI-assisted analysis of publicly available information. It is informational only and is not professional mechanical, engineering, or safety advice. Always verify fitment, compatibility, and installation requirements yourself, or with a qualified professional, before purchasing or installing any part.

A brand appearing in a ModScout report is not a statement that the modification is legal to install or operate in your city, state, or country. Emissions, noise, lighting, and other vehicle modification laws vary by jurisdiction and change over time. You're solely responsible for confirming that any modification complies with your local and federal laws before installing or using it.

4. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or make a purchase on ModScout.

You're responsible for keeping your account credentials secure and for any activity that happens under your account. Let us know at the email above if you believe your account has been compromised.

5. Free tier

The ranked brand list is free to use. Some searches require a free account to prevent abuse of the service. Creating an account does not obligate you to purchase anything.

6. Paid reports ($4.99)

A one-time payment of $4.99 unlocks the full report for one specific vehicle and modification category. The report is generated and delivered immediately upon successful payment. Because the content is delivered in full right away, all purchases are final and non-refundable. If a payment succeeds but a report genuinely fails to generate or deliver, contact us at the email above and we'll make it right.

7. Builder subscription ($8/month)

The Builder subscription is billed monthly through Stripe and renews automatically until cancelled. It includes unlimited paid reports and an unlimited garage for as long as your subscription is active.

You can cancel anytime from your account page. Cancelling stops future billing, and you keep Builder access through the end of the period you've already paid for. We don't provide partial refunds for the unused portion of a billing period.

8. Affiliate links

Some brand and retailer links on ModScout are affiliate links. If you make a purchase after clicking one, we may earn a commission at no additional cost to you. We only link to a retailer when we're confident they carry the recommended brand, and affiliate relationships never influence which brands are ranked or recommended. 9. User submissions

If you submit a vehicle through our "request a platform" feature, you're giving us permission to use that information to decide what to add to ModScout next. We don't publish your submission publicly. Providing an email with your request is optional and used only to let you know if we add the vehicle you asked for.

10. Intellectual property

The ModScout name, logo, website design, and the text and organization of our reports belong to Daniel Colwell. You're welcome to use ModScout for your own personal reference, but you may not copy, scrape, republish, or redistribute our content or brand rankings without our prior written permission. Brand names and trademarks referenced in our reports belong to their respective owners.

11. Acceptable use

Don't attempt to circumvent rate limits, scrape the service at scale, or use it in any way that could disrupt it for other users. We reserve the right to suspend or terminate accounts that abuse the service.

12. Service availability

ModScout depends on several third-party services to operate, including our database, payment processor, and AI providers. We're not responsible for interruptions, delays, or errors caused by outages or issues with those third-party services, or by any other circumstance reasonably outside our control.

13. No warranty, limitation of liability

ModScout is provided "as is," without warranty of any kind. We don't guarantee that any brand recommendation is complete, current, or error-free. To the fullest extent permitted by law, ModScout and Daniel Colwell are not liable for any damages arising from your use of the service, including any purchasing decision made based on its content.

14. Changes to these terms

We may update these Terms as ModScout changes. Material changes will update the date at the top of this page. Continuing to use ModScout after a change means you accept the updated Terms.

15. Severability

If any part of these Terms is found to be unenforceable, the rest of these Terms remain in full effect.

16. Governing law

These Terms are governed by the laws of the State of Idaho, USA, without regard to conflict-of-law principles.
